TERMS AND CONDITIONS AT
GATHERING PLACE PICNIC CO.
THE NOT SO FUN PART!
BUT THIS STUFF IS IMPORTANT!
INVOICES: Gathering Place Picnic Co. LLC will invoice the Client after completion of the request form The Client agrees to pay invoice(s) by the due date(s) specified. Unpaid or overdue invoices may result in suspension or termination of the event.
NO REFUNDS OR CANCELLATIONS: The Customer will be assumed to have accepted the Goods unconditionally unless a claim that the Good(s) are defective is made within [time of departure from event]. We do not offer refunds or cancellations. We can reschedule your picnic within a 48 hour notice. If it is less than a 48 hour notice, there will be a 20% fee.
PAYMENT METHODS: Payment will be made to Gathering Place Picnic Co. LLC via mobile payment (Venmo, Paypal, or approved card payment) or by any other payment method agreed upon by Gathering Place Picnic Co. LLC.
DOWN PAYMENTS: A 50% down payment is required to hold an event time. No time slots or event will be booked until the 50% down payment is paid.
LICENSING: Gathering Place Picnic Co. LLC promises that it holds all licenses necessary to perform the work, that such licenses are valid and effective as of the date any services are provided, and that all services provided will be done in compliance with all applicable federal, state, or local laws and regulations.
AUTHORITY TO SIGN: Each party has the authority to enter into this Contract and to perform all of its obligations under this Contract.
TERMINATION OF CONTRACT: The Contract ends on [after the event date at departure time] unless one of the parties ends the contract before that time. If one of the parties chooses to end the Contract prior to scheduled event date, the Client will not be refunded the Down Payment unless otherwise stated by Gathering Place Picnic Co. LLC.
MODIFICATIONS: The Client and Gathering Place Picnic Co. LLC must agree to any changes to this contract in writing.
LOCATION RULES AND RESTRICTIONS: Fees or restrictions may apply to certain locations. We work in the Kingsport, TN area. We are familiar with Kingsport City Parks and Laurel Run Park. When using a public location, the Client is liable for following the specific location's Rules and Regulations as well as Gathering Place Picnic Co. LLC Service Agreement. Gathering Place Picnic Co. LLC holds the right to decline service at any residency or location.
TRAVEL FEES: Gathering Place Picnic Co. LLC is located in the Kingsport, Tennessee area. Services requested outside of the Kingsport, TN radius will have an added travel fee for $40. Gathering Place Picnic Co. holds the right to decline travel outside of range that is deemed too far.
BAD WEATHER: A reschedule date will be given to the Client in instances of bad weather during the scheduled event time. There is no charge for the reschedule of the date and time. The Client has a 3 month time frame to reschedule the event date and time.
PUNCTUALITY AND LEAVING EARLY: The event time starts at the agreed time set in the invoice. The Client has 30 minutes to arrive at the agreed location from the agreed start time. Failure to arrive within 30 minutes will result in cancellation of the event with no refunds. In accordance to leaving before ended schedule time, a given notice of 30 minutes is required by the Client. The Client is responsible for all the items at your event until an employee arrives at the location. No refunds can be made for leaving early.
FOOD, DRINKS AND ALCOHOL: Gathering Place Picnic Co. LLC allows food and drinks to be consumed at the event. Gathering Place Picnic Co. LLC does not supply and is not liable for any possession of alcohol. Anything brought to the event is the responsibility of the Client and Gathering Place Picnic Co. LLC is not responsible for any consequences. When visiting a public location, that location's rules must be followed by the Client. Gathering Place Picnic Co. LLC is not responsible for any instances of the Client breaking rules and regulations of all public locations.
DAMAGED OR STOLEN ITEMS: Gathering Place Picnic Co. LLC is aware of condition and items supplied at all events. The Client is responsible for all items supplied at the agreed event. Damages or stolen items will result in payment from the Client for the amount of the stolen/damaged item.
FIRE: Gathering Place Picnic Co. does not supply fire for candles or any occasions. The Client is responsible for any and all damages that occur to fire during the scheduled event. Certain locations may prohibit fire and the Client is responsible for following certain rules and regulations based on location.
SET-UP AND CLEAN-UP: Gathering Place Picnic Co. LLC supplies set-up and clean-up of all events. The Client will need to supply 30 minutes before scheduled event for time of set-up. The Client will also need to supply 30 minutes after scheduled event time for clean-up of event.
CLIENT AVAILABILITY: The Client promises to be reasonably available to the Business if the Business has questions regarding this project, and to provide timely feedback and decisions.
EXPENSES: Client will reimburse Gathering Place Picnic Co. LLC for reasonable expenses incurred by Gathering Place Picnic Co. LLC in the provision of services under this Contract. Signatures This contract may be signed electronically or in hard copy. If signed in hard copy, it must be returned to the Business for valid record. Electronic signatures count as original for all purposes. By typing their names as signatures below, both parties agree to the terms and provisions of this agreement.
